Biography

Will Fischbach is a Shareholder in the Phoenix, Arizona office of Tiffany & Bosco, P.A. Will is an experienced trial attorney who focuses his practice on complex commercial disputes, real estate, condemnation/eminent domain, and select catastrophic personal injury and wrongful death cases. He is rated AV Preeminent® by Martindale-Hubbell®.

Will’s recent results for his clients include:

  • $3.2 million judgment for a property owner in a condemnation case arising from a county highway project
  • $2.1 million judgment in a successful breach of contract claim against an Arizona county
  • $1.6 million settlement of a products liability personal injury claim on behalf of the injured party
  • $1.1 million judgment for a property owner in a condemnation case arising from a highway overpass
  • Prevailed on behalf of the defendant on a trade secrets claim in which the plaintiff sought $167 million in damages
  • Prevailed on behalf of the defendant in a tortious interference case in which the plaintiff sought $4.5 million in damages, but was awarded only a $1 judgment
  • Won jury verdict in defense of a property owner against a plaintiff seeking $800,000 in damages on alleged claims of nuisance and water damage
  • Won summary judgment in a breach of contract claim against a professional athlete, resulting in a $930,000 judgment
  • Won summary judgment representing a farmer against a lender in a $1.3 million crop dispute
  • Won summary judgment in defending a newspaper against a plaintiff seeking $1.8 million for alleged defamation

Will’s community activities include serving as the Chairman of the Board for Goodwill of Central and Northern Arizona, the Vice Chairman of the Camelback East Village Planning and Zoning Committee, and a member of the State Bar of Arizona’s Civil Practice and Procedure Committee.

Will’s first courtroom experiences were in the United States Army Judge Advocate General’s (JAG) Corps, where he served with the 101st Airborne Division and 82nd Airborne Division. Will was the lead prosecutor in the Mahmudiyah Massacre—considered by some to be the most heinous war crime of the Iraq war—and won convictions in each case.  He finished tours of duty in Iraq, Afghanistan, Uzbekistan, and the Republic of Korea, and successfully completed Airborne, Air Assault, and Pathfinder training.  Will was honorably discharged in 2008 at the rank of Major and is a recipient of the Bronze Star Medal.

Will received his B.S. from Arizona State University in Tempe, Arizona and his J.D./M.B.A. from Tulane University in New Orleans, Louisiana.

In his free time, Will enjoys training for and competing in Ironman races and short-course triathlons, as well as weight training, mountain biking, and snowboarding.
