Robert Mitchell and his litigation team, Sarah Deutsch and Chris Waznik, have had a busy and successful 2016 so far.   In February, they won a record $38.5 internet defamation verdict in a US District Court trial in Las Vegas in favor of a Los Angeles investment professional.  [Cohen Asset Management, Inc. v. Northwest Territorial Mint, LLC, Case No. 2:12-cv-01401-JCM-PAL]  The record verdict was upheld, and the amount of the award not reduced in a post-trial ruling by the federal court judge in May.   In March, Robert Mitchell and Chris Waznik also won a unanimous jury verdict at trial in Maricopa County Superior Court in favor of an Arizona real estate brokerage firm.  [DAUM Commercial Real Estate Services v. Intravest 2851 Kathleen, LLC, Case No. CV2014-014493].  In addition to two successful jury trials, Robert and his team have prevailed on two appellate decisions, one in the Arizona Court of Appeals in an investment case, and one in a case before the Supreme Court of the State of Utah on behalf of an industrial park owners association addressing the business judgment rule and resultant discretion afforded owners associations under CC&Rs, which decision will be officially published in the Pacific Reporter [Fort Pierce Industrial Park Phases II, III, & IV Owners Association v. Atlas Tower, LLC, 2016 UT 28 (2016)].
