Biography

Tim is a detailed-oriented problem solver who is committed to serving his clients in a results-driven and tailored approach. Tim’s practice includes pre-litigation disputes, litigation, and trial work, having successfully resolved, prosecuted, and defended numerous actions. Tim’s litigation practice includes real estate disputes, breach of loan agreements, breach of contract, fraud, insurance coverage, landlord-tenant disputes, and eviction actions.

Tim’s pursuit does not stop once the trial is over and victory achieved. Tim has enforced and collected on Arizona judgments—obtained on behalf of plaintiffs and defendants—and has domesticated and enforced judgments obtained in other states and foreign countries.

Tim has also negotiated and documented real estate transactions on behalf of buyers, sellers, and landlords, including transactions involving seller carryback financing and conventional financing. Tim performs business formations and documents and negotiates business transactions incident to his clients’ real estate transactions.

Tim was born and raised in Arizona and has lived in Arizona other than his stint in Chicago for law school. He is an avid Arizona sports fan. In his spare time, Tim playing golf and spending time with his wife and kids. Tim and his family are members at Paradise Valley United Methodist Church.

REPRESENTATIVE EXPERIENCE

Litigation

  • Obtained a judgment at trial on behalf of a client against a partnership and former partner on claims of breach of contract and breach of fiduciary duty. The client was awarded damages, attorneys’ fees, and costs in excess of $200,000.
  • Successfully defended against a $800,000 real estate dispute involving alleged nuisance and water damage in a 6-day jury trial.
  • Obtained a defense verdict at trial in a fraudulent transfer, alter ego, and breach of contract lawsuit that sought damages in excess of $1.5 million.
  • Negotiated a $100,000 policy limits settlement against the adverse driver and a confidential uninsured/underinsured coverage claim on behalf of an individual injured after a car ran a red light and struck the individual’s vehicle causing significant damage.
  • Successfully defended against a motion for order to show cause and alleged breach of a settlement agreement and obtaining a five-figure award of attorneys’ fees and costs.

Transactions

  • Represented buyer in resolution of business dispute that resulted in buyer purchasing co-owners’ portion of multi-million-dollar property.
  • Represented seller in multi-million-dollar sale of hospitality property in Arizona.
  • Represented landlord/seller in lease with purchase option transaction of historic church.
