BIOGRAPHY
Kevin is an attorney with Tiffany & Bosco whose practice focuses on Construction, Mortgage, and Real Estate transactions and litigation. He practices extensively in all areas of risk management related to the Construction, Real Estate and Mortgage industries.
Kevin is adept at aggressively and economically pursuing his clients’ claims or defenses when required.
The clients Kevin represents cover a broad spectrum and include institutional and private lenders, contractors, subcontractors, suppliers, architects, engineers, and owners.
Kevin’s specific areas of Construction industry practice include mechanic’s liens, payment and performance bond claims under the Miller Act and Arizona’s “Little Miller Act,” sustainable (“green”) building, construction defect claims and defenses, Arizona Registrar of Contractor complaints and defenses, and construction contract review.
Regarding the Mortgage industry, Kevin’s specific areas of practice relate to compliance with Federal and state laws and regulations. Kevin’s federal experience includes assisting his clients to comply with, or defend against claims concerning, the Truth in Lending Act, the Real Estate Settlement Procedures Act, the Fair Credit Reporting Act, the Fair Debt Collection Practices Act and the Equal Credit Opportunity Act. Kevin’s state experience includes assisting his clients to comply with, or defend against claims concerning, Arizona’s consumer protection laws.
Although somewhat overlapping with Kevin’s Mortgage industry practice, Kevin’s Real Estate industry practice includes review of both commercial and residential purchase agreements and associated documents, review of property management agreements, compliance with Arizona’s mortgage and deed of trust statutes under Title 33 of the Arizona Revised Statutes, and pursuing deficiency, mortgage fraud, equitable subrogation, and forcible entry and detainer (eviction) claims on behalf of his clients.
Kevin also practices in the area of Indian law and is licensed with the Navajo, Hopi, Fort McDowell Yavapai, and White Mountain Apache tribal courts. His Indian law practice focuses on assisting his clients navigate the particular requirements of those sovereign nations.
Kevin’s experience has given him the knowledge and insight necessary to give his clients both practical and legally sound advice in a cost efficient manner.
